A federal judge denied a motion for a new trial by former Henryetta city manager Raymond Eldridge Tuesday.
US District Judge Ronald A. White denied a motion for a new trial stating Eldridge failed to file an amended complaint with the Eastern District Court in Muskogee.
That eliminated a large part of the suit against former mayor Bill Goodner and councilmen Audie Cole and Henry Koelzer as well as city manager Ted Graham and city clerk Donna White.
Another part of the lawsuit still exists with former councilman Mickey Dombek and the city of Henryetta as defendants.
Eldridge sued the city in 2014 claiming rongful termination as well as failure to provide a safe workplace, breach of contract as well as violations of council members acting outside the scope of their official duties, failure to follow city personnel policies.
He also claimed while serving as city manager, he was subjected to bullying, harassment and intimidation.
Eldridge resigned as city manager April 25, 2013.
He also has an ongoing lawsuit against the Oklahoma Firefighters Pension and Retirement System.
